Well that looks like one of Rick's PKDs, so I'd assume its one of his pics. Going by what I know of Photoshop, I'm pretty sure they took the photo, quick masked the blaster, then isolated it, and superimposed it on that background, thereby getting around any copyright issues. Its scumbag work though. After that they probably shoot it through an Epson photo printer on canvas paper for the el cheapo art print feel. Gives legit digital artists a bad rap.

Thing is, it's still copyright infringement (a 'derivative work'). Go sue.

I'm not condoning copyright infringement in any way, just pointing out that is why they did it the way they did. Its a blatant attempt to get around the copyright issues.

As for suing.... would you really want to go to court over something that even once you've won, the settlement is still likely to be less than your lawyers fees?

I highly doubt anyone buys these prints. From an artistic stand point, subject matter aside, this print lacks both creativity and compositional elements that would make it viable even as an abstract. I can guarantee if I'd ever turned in a shape on a field of color with a layer drop shadow effect as finished art, they would have flunked me out of school.

It would need to devalue Rick's guns for it to be a copyright infringement (I believe Confused ). Instead I think it adds value to them. Drew Struzan used pictures of Rick's guns in his paintings and sketches for his BR poster art and concepts. Deviantart also has a bunch of pictures based on his gun design (search image deckard or blade runner gun in google). Not to mention the Android Hunter figure from Japan uses his gun as the model for the die cast miniature that the figure weilds. Not to mention we all call them PKD's now, which is a name that Rick first used for his guns.

The only people who I think would have a right to bitch about it might be the BR Partnership. Though it would be nice if they would give Rick a bit of their cut Smile

I think they may have used this photo I took in 2000.



Although no one ever asked me for permission to use my photo, I'm more flattered than upset about this. The PKD-II 2018 Model was my "generic" gun version, So I am happy to let this sleeping dog sleep. Had they used one of my more unique, or original designs (i.e. PKD SNUB, Magnum, Enforcer, etc.) I would feel differently about this matter.

Regardless of the IP in the gun, the copyright in the image belongs to you. 'Sup to you - just pointing it out. Personally, I'd go nuts. Smile

You could always email them and say the Gun they show isn't actually from Blade Runner, but an original creation of yours inspired by the movie, and then ask for at least some credit, if not you might be able to Vero them by showing ebay your photo. Using a photo of yours as their basis may have more issues with it than using the actual gun as reference. Also at issue is if they have more than one of these for sale and are showing concious capitalization of your work, as opposed to a one of a kind piece of Pop Art.

I personally still think it adds value to your gun and continues to establish it as an icon of BR gun models. "Free Advertising" to some degree. I have an Art Gallery of work inspired your gun on my old hard drive, as you know I have shown you, or sent you the images. I think it might be worth contacting them to at least give you credit for their "inspiration".
